Dear Riverwalk Homeowner,

Riverwalk Homeowner’s Association, Inc. needs your help.  We have found ourselves to be in serious financial difficulty due to some homeowner’s not paying their dues.  At this time we do not have enough funds in our account to pay for just landscaping through the end of the year.  We currently are owed over $6,000.00 in past due assessments.  We have made many efforts to collect this money but have received little cooperation.   We are now going to be forced to foreclose the lien on these homes, as is our right per our declarations.

In order to do this, however, we need to hire an attorney.  Since our funds are so limited we have found it necessary to apply a special assessment to each home in the subdivision in the amount of $50.00.  This money will be used to pay our bills through the end of the year as well as for the legal fees associated with foreclosing on the homes.  All legal fees will be collected back from the delinquent owner.  Attached to this letter you will find an invoice for the $50.00 assessment.  We do not feel it is fair for the upstanding residents in our community to pay their annual dues and for others not to.  It has come time that we must use legal means of collecting these debts.

In addition, we would like to address our current annual assessment rate of $140.00.  This amount allows us only to pay the bills every year and nothing else.  Our landscaping and maintenance of the retention areas currently uses up over seventy-five percent of our annual budget.  We have no additional funds to put into a reserve account, which would certainly be helpful at this time.  We have discontinued Yard of the Month, our annual National Night Out gathering in the park and the newsletter in order to cut down on expenses.  We would like to propose to raise the annual assessment fee to $175.00 per year.  This amount will allow us to put money into reserves for future emergency situations as well as keep our budget on track.  We cannot raise the fees without a two-thirds majority vote of the membership.  You can expect the members of your elected board of directors to be visiting you over the next few weeks to discuss the increase.  We really need to do this if we are going to keep a working association.  

On another note, we would like to take this opportunity to update you on a few other items:

Deed Restrictions – Again, due to lack of funds we have been unable to legally prosecute those homeowners in continual violation of the deed restrictions.  Our management company is currently working on a Fining Resolution for the Board of Directors to formally adopt and file with the County Clerk’s Office.  This will be an addendum to our by-laws and will be mailed out to all homeowners when complete.  It will allow us to assess daily fines to those in violation in order to obtain compliance.  We are doing this because we want to keep our community looking it’s best and our property values up!

Webpage – Board member Danny Frank has volunteered to donate a webpage to the association.  It will be an area to post comments, concerns and inquiries as well as obtain valuable information.  We will keep you posted as this comes along.

Directory – We would like to have a working directory of the membership.  When you forward your special assessment fee, please take a moment to fill in the included information form with your Name, Address, Phone number, E-mail address and Occupation and return it with your payment.  This will help us in keeping everyone updated on what’s going in the community as well as having information on hand in case of an emergency.

I am very concerned about the number of unpaid dues.  I understood we have always had an attorney.  What happened?  Also, isn't the mowing of the ditches the responsibility of Brazoria County or the City of Pearland?  Are we possibly paying for something they are being paid for but not doing?  

Also, I hate speed bumps like crazy, however, we have a serious problem on Lochmoor Ln.  We have speeders driving up to 60 mph and risking the lives of the children in the neighborhood.  I would absolutely contribute to the cost of speed bumps.  The police can't always be here when these jerks speed by, and that is the only solution I can think of.  I will pay the special assessment, but would like to talk to a representative about this personally.  Thanks!

The home owners own the common areas.  Therefore we have to mow all of the common areas and take care of them.  Speed bumps…. Well, they cost money and we are short of money already.  I think it best if you see someone speeding, take down the license plate and notify the Pearland Police Department at 281-652-1105.  And let them do their job. If they get a lot of complaints, they will respond.

Hi Sarah,

The problem is we do not have the funds to pay the attorney fess up front.  The special assessment wil give the association the flexibility to use whatever legal means are necessary to collect these past dues.  As far as the retention areas go they are part of our common area and we are responsible for maintaining them. If we do not, the city fines us.In fact I just received a letter from them and they are scheduled to be mowed this week.

In regards to speed bumps, the city does not allow them because the hamper emergency vehicles.  The only way to have them would be to become a gated community.  In that case, the association would have to assume responsibility for all street maintenance in the subdivision.  I will, however, request a speed survey from them.  They will monitor for about two weeks.  If they find excessive speeding they generally will step up survelience and install additional speed limit signs.  I will put in the request today.  Please let me know if you have anymore questions I can assist you with, thank you.

I am not awhare of Riverwalk ever flooding... I know that no houses have ever had water in them and I have lived here since 1993.  I don't evan recall the streets ever beeing flooded.

I am a resident who pays their yearly dues on time and in full.  I am also a resident who does not deface their property nor park evhicle in the stree for weeks at a time.

As far was this new "special assessment fee" for those in the neighborhood who do not pay thier dues I refuse to pay an additonal $50.00.  I was one of the residendt that voted for the increase in dues.  I would rather pay the increase of $35.00 a year than be impossed a $50.00 a year special assessemnt fee.  The math is very simple.  

I have also looked over the budget that was sent out and will be more than willing to donate my time to hand deliver all the news letters.  That should cut down substantially on the amount the we spend on the postage.  And allow me to get to know my neigbors better.  I will also be contacting some of my subcontractors to see if I cannot find a better deal on the landscaping for our negiborhood.  Again, I will not be paying this years special assessement fees, so that others can continue to not pay thier basic dues.

I appreciate your comments, but, last year in 2007  we only sent out a newsletter 1 time, that was required to be mailed because it was the end of the year ballot forms, for the HOA board. For the last several years I have personally delivered the newsletters to keep from mailing them. Also, we have received 8-9 bids for the mowing and they are all higher than we are currently paying. Thankfully the current company "GrassRootz" has agreed to mow again this year for the same price.

Unfortunately our hands were tied about raising the assessment. We needed 82 homeowners to be in favor of, and we did not get enough. Even though we had more at the annual meeting than ever before, we didn't meet the requirement. Looking at the budget IF EVERYONE PAYS THEIR DUES, we are still in a deficit of $1500. Our current fees do not meet our budget requirements, and we have cut everything possible. Thank you for your input and any ideas that you can come up with.

We seem to be having a problem in the neighborhood with trash accumulation, and pick up. Regular trash pick up is Tuesday and Friday, with recycle being Tuesday and heavy trash on Friday. Tree brush and limbs will NOT be picked up if they are not bundled, more than 5' long, and more than 50 pounds. Plan accordingly. Tree branches fall under heavy trash pick up on Friday.

I have gotten this letter.  I have also paid my dues.  The check has been in the black mailbox for over a week now.  Quit sending me nasty letters wich state you are in trouble because of "people like me".  Pick up your check and cash it, leave me be.
